Hi ,
Does it impact I140 processing if i am outside US and worked with same employer in India ?
I have left for india assignment after concurrent filing (I 485 + I 140)
for 4 weeks and joined back in US for different assignment last year after July filings.
But i have maintained my old residence status and applied for change of address when i came on different assignment and loaction in US.

Has any one experienced similar situation ?
Does on US payroll becoming inactive for some duration ( in my case 4 weeks) make the I40 processing questionable ?
Can anyone advise ?

Hello immi2006,

Were your collegues EB-2 classification with old PDs from the DoL's backlog centres?

I see some of the EB-2 indian nationals with old PDs received approvals so that USCIS can process their I-485.

If you are EB-3 then you might want to wait until Dec 2007.

Just get a letter addressed to Consular Office, US Consulate , City ( where your wife is scheduled for interview) . In the letter just mention in subject line "request to grant visa to spouse of Mr XXX" and in body just mention the details like Mr XXX is working with us since DATE As DESIGNATION and his salary is $XXXX. We request you to please grant his spouse Mrs XXX H4 visa so that she can join her husband in USA.

Not sure about the first question. SKIL bill will exempt any advanced degree from US or Advanced degree in STEM from outside + 3 Years. PACE, TALENT and the current CIR only exempt STEM Advanced degree + 3 Yrs
I am not totally sure. I recall reading one amendment where they mentioned 203(b) in conjunction with this - which means EB2 qualification.

Hi ,

I got my H1B extension done and seeing issues with that, please can somebody help me out on this ASAP. My old I797 is valid till June 14th 2010 , when I went to India I got an I-94 issued at port of entry which has the date June 24th 2010.

Now my current I797 has been approved from June 25th 2010.

What is my status from Jun 14th to June 25th ? Am I in status because I have a I94 valid till June 24th or will I be out of status for those 10 days ?

Can I work and have my payroll run for hose 10 days (June 15th to June 24th)

Please respond ASAP as I have very short time to act on.

Any suggestion on how we can approch sending the approved LCA later and ask USCIS to match it to the already submitted H1B petition?

I dont see a problem if you have I 485 Pending ( i assume you have EAD to continue working )

Folks,

My Green Card was recently approved. But, due to retrogression I had not filed for my wife's green card.We did file her I-485/EAD/AP during the month of July. My PD is around 2003, and I dont see my wife's GC being approved very soon.

My questions are:

1. What kind of documents are required in the future? Lets say, I start a company and work for my own company. In that scenario, what are the requirements I need to fulfill to keep her application in good standing.

2. What happens if I go without a job for a few months(between consulting gigs). Does this adversely impact her application.

3. At the minimum, how do I keep her application in good standing, and be ready to respond to future RFE's.

I am not sure if these questions were discussed in this forum. I would appreciate if anyone can point me to any links.

Last year I sent both the ITIN form and 1040 to the ITIN address. Once the ITIN is processed, they will update your 1040 with the ITIN number and forward it to the respective department for processing. I got my refund back after 8 weeks. Since I am in Texas I didnt have to file for state taxes..So not sure about the state tax filing part....

Dear Friends at forum:
My husband was an Asylee (approved asylum) when he got married to me. But he got the Green card through me. I am a US citizen. Now he wants to apply for Citizenship through me.
when we applied for his Green card he had to renew his passport of his country of citizenship. it was one of the requirements. That country of citizenship was obviously also the county of his persecution. there was absolutely no issue about it at the time of his Green card interview.
But could it be a problem for citizenship interview?
He never traveled to his country of citizenship nor to any other place. He has never left USA ever since he came here. Does his asylum case will again surface at the time of citizenship even when he is applying for citizenship through me?My understanding is that the asylum thing is no more the issue if he got the GC through me??

Your advice, input and suggestions will be highly appreciated.

I visited the country first ~8 yrs ago as a visitor. I got a job offer from a desi company and they filed for my H1. I was never informed about status of the H1 petition. I was informed I am in status and it was OK to stay longer than the time allowed by my I-94 (in a visitor status).

In the process, I ended up staying about 10 days longer, but then I returned to India, and came back after a couple of months, again as a visitor.

Now I'm on a H1B (8th year) with I-140 approved, but haven't traveled at all, and would like to get a visa issued/stamped in my passport.

I have since lost touch with that employer and they don't seem to be in business any more, nor can the owner be contacted.

I recently learnt from someone that the petition was in fact approved.

I called USCIS, and I was told the employer who filed the petition can file a form (I-824?) to get a duplicate copy, but they need to attach a copy of the original as proof!! *Or I can file a request under Freedom of Information Act*, they're not sure how long that'll take to get processed.

Questions:
1) Will the overstay become a problem? I do not have any documentation of the filing/status/approval of the H1 petition filed at that time.
2) How else can I get a copy of the Approval Notice to prove I wasn't out of status during the less than 2 weeks of overstay about 8 years ago?
3) Will this become a problem with my I-485 (whenever that will be filed with a PD of early 2006)?

If one applied for his I-485 before the H-4 visa was expired, then not a problem. The minor could obtain a new h-4 visa stamp overseas. He / she should take AP with her / him just in case they can't issue a visa for any reason.
Generally speaking, one who has a pending form I-485 is not obligated by law to maintain any other status such as H-1 or H-4 and the time after the expiration of such a status is not counted as unlawful presence as long as the pending i-485 is not denied.

Hi

My wife recently went for a H1B renewal stamping in india. They visa officer provided a 221(g) administrative processing (pink) requesting additional documents (job description, reasearch projects, previous visas list etc..,). She is preparing the necessary docs to submit the same. Since she went to india for a short trip (travelling back next week).

1. She has Advanced parole. Can we use Advance parole??
2. If we use Advance parole, then once the Adminstrative processing is complete, how do we handle the stamping?? Do we need to go back again to the consulate to get the stamping done? or is there a way to withdraw the visa application from the consulate??

I would greatly appreciate if someone is similar situation share their experiences

Hi All,

I need to travel urgently to India due to some family issue and my EAD is expiring in Aug 2010. I need to apply for my renewal before I fly out this Sunday since I will have to be in India for 30 days. Can I e file my application from here and send the supporting documentation by Saturday? If so, I want to make sure that if for some reason, I get a biometrics appt., while in India, how can I postpone it? and also there won't be any issues with my EAD renewal app since I will be India and My I 94 will change once I am back.

Hi All,

Here is my question.
I was working for employer A.I left employer A on Nov 15 , I received my last paycheck from employer on Nov 22, 2007.
I know my employer A did not revoke / cancel my H1b.

I accepted offer from employer B on Nov 20.I came in communication with employer B lawyers on Nov 23.I am based in one state and work
in another state.Lawyer got all the documents from me on Nov 25,Then she said , we will have to get prevailing wages from two states , and she
send the request for them.We received prevailing wages from states on Dec 11.Then she sent my H1b transfer petetion to USCIS on Dec 14.I received
the receipt from USCIS on Dec 18.

Will my H1b get transferred , or will I have any issues.

Gurus,

My H1B extension is pending with the VSC. I want to upgrade my H1B extension to a premium process by paying 1000 USD.

Now, my question is - Can I do it myself thru efile or regular way using form I-907? Or should it be done only thru the employer or attorney?

I am asking this because my attorney is charging a ridiculous attorney fees of 250 USD on top of 1000 USD for upgrading my case to a premium!

Here is the journey:

Nov.2002 - RIR Labor filed in CA
June 2006 - Labor approved from Phily BEC
July 2006 - I-485 , I-140 filed at TSC
Sept.2006 - I-140 approved
Got stuck in namecheck ( name check may be still pending )
May 20, 2008 - RFE received for missing TB Skin test ( doctor screwed up)
June 4, 2008 - Responded to RFE
June 16, 2008 - Green card approved
Now, waiting for the actual card to arrive.

What format are you saving images in? As I understand from what I've been told (I've shot with a D70, D1, and D200, but not a D100), the D100 can be quite a pain to use with compressed RAW, as it becomes very slow; are you sure the settings haven't somehow gotten changed to use RAW compression?

My PERM for EB3 has been approved on July 2008. My I-140 is pending. 485 has not been submitted yet. I don't have EAD card either. For some reason, I have to change job.

My question is, if my current employer will not revoke my current I-140 sponsorship, even I have left company, and in case my current I-140 will be approved, can my priority date be carried over?

My friend has a GC since Sep 2004. He recently went to India and married a person who has a stamped F-1 Visa though she has not entered the USA yet. They are planning to enter US this month. Is this legal? What should they be worried about and what are my friend's options if he wants to settle down with his wife in the USA. I am working for a company A with whome I have gone ahead and resigned with them i also filed my GC and 485 is still pending with them and also have EAD through them, recently i got offer from Company B which i accepted and they have gone ahead and filed my H1 Tranfer but recently i got one more offer from Company C which is much better.
What should be done in this scenario,should i again file for H1 Transfer through Company C or will it mess up my case even more

I have had my GC for about two and a half months now. I am currently checking out SOA consultant positions with a consultancy in Saudi Arabia. I don't know the length of the contracts yet. Can I work out of USA and still apply for Citizenship after the wait of 4 years and 9 months ? Does this require me to stay a certain amount of time in USA for every year ? Interfiling can be a success or a failure depending on how you/your lawyer treats the case.

I know someone who successfully got his interfiling done from a 2007 EB2 to 2004 EB3 date and has the GC already.

Now,
Even if your lawyer files the case perfectly there is a chance that the case lands with an IO that either doesnt "LIKE" interfiling or doesnt understand it. So then again the casse might take longer than usual.

But as far as I know , cases are done and I havent seen any case that was filed properly being rejected, nevertheless there are people who are still waiting for adjudication but not rejected.

I am sending my kid ( US born) with my in-laws to india. Any idea what kind of documents they need to carry ( other than passport, PIO, Birth Certificate)

Do not forget to give grand parents a letter, duly signed by you and your wife that they are taking a minor US citizen, out of the country with parent's consent. I do not have any particular format to give you. Get it notarized, also mention the dates for which he will be outside the country. I had a tough time with Air France few years ago, I was taking my own baby and my wife was not travelling with me. Air France denied me bording because I did not have a wrttien permission from my wife !! It also differs from airline to airline.

I havenot received any FP notice till yet though I have got my 485 notice.
If I want to change the location of FP,can I do that?Because my project is getting over and I have to relocate to Texas from California.
If my FP test is scheduled for California,Can I apply for a change in location for Texas?

Thing is inspite of these recommendations they reverted the July bulletin with no notice period to public. Not sure why they recommend and have the office Of Ombudsman if USCIS does not implement their recommendation?
