Hi ,
Does it impact I140 processing if i am outside US and worked with same employer in India ?
I have left for india assignment after concurrent filing (I 485 + I 140)
for 4 weeks and joined back in US for different assignment last year after July filings.
But i have maintained my old residence status and applied for change of address when i came on different assignment and loaction in US.
Has any one experienced similar situation ?
Does on US payroll becoming inactive for some duration ( in my case 4 weeks) make the I40 processing questionable ?
Can anyone advise ?

Its not a problem. As long as your I-485 is applied and pending , you can apply any time.

Hello immi2006,
Were your collegues EB-2 classification with old PDs from the DoL's backlog centres?
I see some of the EB-2 indian nationals with old PDs received approvals so that USCIS can process their I-485.
If you are EB-3 then you might want to wait until Dec 2007.

Just get a letter addressed to Consular Office, US Consulate , City ( where your wife is scheduled for interview) . In the letter just mention in subject line "request to grant visa to spouse of Mr XXX" and in body just mention the details like Mr XXX is working with us since DATE As DESIGNATION and his salary is $XXXX. We request you to please grant his spouse Mrs XXX H4 visa so that she can join her husband in USA.

Not sure about the first question. SKIL bill will exempt any advanced degree from US or Advanced degree in STEM from outside + 3 Years. PACE, TALENT and the current CIR only exempt STEM Advanced degree + 3 Yrs
I am not totally sure. I recall reading one amendment where they mentioned 203(b) in conjunction with this - which means EB2 qualification.

Hi ,
I got my H1B extension done and seeing issues with that, please can somebody help me out on this ASAP. My old I797 is valid till June 14th 2010 , when I went to India I got an I-94 issued at port of entry which has the date June 24th 2010.
Now my current I797 has been approved from June 25th 2010.
What is my status from Jun 14th to June 25th ? Am I in status because I have a I94 valid till June 24th or will I be out of status for those 10 days ?
Can I work and have my payroll run for hose 10 days (June 15th to June 24th)
Please respond ASAP as I have very short time to act on.

I dont see a problem if you have I 485 Pending ( i assume you have EAD to continue working )

My Green Card was recently approved. But, due to retrogression I had not filed for my wife's green card.We did file her I-485/EAD/AP during the month of July. My PD is around 2003, and I dont see my wife's GC being approved very soon.
My questions are:
1. What kind of documents are required in the future? Lets say, I start a company and work for my own company. In that scenario, what are the requirements I need to fulfill to keep her application in good standing.
2. What happens if I go without a job for a few months(between consulting gigs). Does this adversely impact her application.
3. At the minimum, how do I keep her application in good standing, and be ready to respond to future RFE's.
I am not sure if these questions were discussed in this forum. I would appreciate if anyone can point me to any links.

...that you submitted and it has a column where you were supposed to fill in the job code. Also, you would have attached a copy of your approved labor to support the application and job category.

Your first two entries are a bit too small, but I can still add them up as an entry. For your other entries, some of them are (as you mention in the descriptions) photos that you took and vectorized. Unfortunately, those will not qualify, for the goal is for you to draw manually without converting an existing photo.
To answer your question, your first two entries and the this one (http://kwijl.deviantart.com/art/MyBobblehead-64787112) seem to qualify!

Last year I sent both the ITIN form and 1040 to the ITIN address. Once the ITIN is processed, they will update your 1040 with the ITIN number and forward it to the respective department for processing. I got my refund back after 8 weeks. Since I am in Texas I didnt have to file for state taxes..So not sure about the state tax filing part....

My husband was an Asylee (approved asylum) when he got married to me. But he got the Green card through me. I am a US citizen. Now he wants to apply for Citizenship through me.
when we applied for his Green card he had to renew his passport of his country of citizenship. it was one of the requirements. That country of citizenship was obviously also the county of his persecution. there was absolutely no issue about it at the time of his Green card interview.
But could it be a problem for citizenship interview?
He never traveled to his country of citizenship nor to any other place. He has never left USA ever since he came here. Does his asylum case will again surface at the time of citizenship even when he is applying for citizenship through me?My understanding is that the asylum thing is no more the issue if he got the GC through me??
Your advice, input and suggestions will be highly appreciated.
