My AP is expired on December 9th 2008. I would like to renew my AP. Could you please provide the details on how to renew my AP? or Does it come as a new process instead of renewal?

USCIS website does not shows that my I-485 has been denied but instead it says that it has been sent to AAO office(appeal processing office).
No I have not yet called attorney on extending EAD based on I-140 denial.

Is your 485 also denied? Most of the times when ever 140 is denied then the underlying 485 also gets denied and if that is the case then you cannot apply or extend for EAD or AP until your appeal is pending with AAO. I may be wrong so consult an attorney.

First of all you are on OPT and your status has not yet changed to H1. It will change to H1 in October.
Your company can cancel H1 with or without your knowledge.
Your new employer can transfer your H1 provided you have the receipt number EAC or WAC number.
If I were you, I would first get the receipt number from your employer and then join the new company on OPT. Also if things do not work out this way, you still join the new company as you are eligible for 17 months OPT extension, you can still qualify for next years H1.
Best strategy is to use as much time on OPT as possible because in that case you dont have to pay social security and medicare taxes.

My parents are planning to go for a visa interview. What is difference between me inviting them to visit me versus they applying as tourists. I understand that if they apply as tourists they need to provide documents showing that they can support themselves.
Will coming as a tourist diminish the possibility of getting 10 year multiple entry visa. Any thoughts on this issue is much appreciated.

My wife did her MBA and used her OPT before marriage. After a gap of OPT period she again went to school and got a MS degree. During her OPT, she did not work at all. Now she is unable to get second OPT for her recent MS degree.
Is there a way out to get second OPT? Can this new law (29 months OPT) if passed, be used to apply for second OPT.
What should be best approach? Please advice.

Thanks for sharing, It describes about Numerical limit not apply during Quarter which means spillover should occur quarterly. I don't think they follow that today.

Hi,
I know this has been discussed a lot but I need advise or suggestions..
I am under Eb2 with priority date of Jan 2007 (labor and I140 approved) waiting for date to be current so that I can file I485 AOS....
My wife wants to convert from H4 to F1 for coming Spring 2011 so that she can take assistantship..
Is it advisable to change status to F1 with priority date so close..? does it cause any problems for her I485 application since F1 status is Non-immigrant category..
Please advise..

I have done stamping at Delhi some time last year January, me and wife attended in the same category, it was very smooth nothing much asked, even the lady who assisted us didnt ask for single document.
We were in the line early morning eventhough our time is little bit late (no body asked us about the interview time)...

I have similar issue and spoke to my Immig Attorney, who advised me as follows-
(1) In order to maintain your resident alien status, you should be in USA more than 181 days, in other words it is adviseable to stay less than 180 days outside USA.
(2) It is adviseable that you return to USA, ASAP, once you get CRIS email that GC approval has been provided.
(3) I believe you are going to use AP. You would prepare your I-94 card at the POA and the POA officer would ask you where you are employed before putting stamp on I-94. Be prepared to answer that question. Most likely 99%, the POE IO will not ask any proof. However, it is adviseable to have a current job (sort of Employment Verification Letter) and leave letter approval.
All the best.

Right now, your Silverlight 2 project is set as your startup project. Set your Web Site as the startup project with the Loading_ImagesTutorial.html file as your startup page.

You can file H1-B extension based on your approved i-140 you should receive another 3 yrs extension i did the same.
Did you file this H1-B extension after changing employer using AC21? Is it approved for 3 years?

Yes, i765 is the EAD card. It will be issues eventhough your i140 is pending.

I have just gone thru March recording of IV lawyer call and the below caught my attention. Ms Susan mentioned that any company name change after I140 approval has to refile I 140. I am utterly confused as that particular scenario affect me and i would like to know what best course of action i can take at this point.
I filed LC and I 140 with company A
My I 140 got approved
Before i filed my I 485 my company changed its name
I asked my attorney at that time if we need to take any special action
Attorney said they can just add an amendment while applying for I 485 about name change and apply with approved I 140, which is with old company name.
I and my wife work on EAD for past 3 years and i am still employed with same company. I wonder which one of above attorney is correct and what i should do.
