I'm glad to see Immigration Voice weighing in on this one. My friends wife applied for h1b and left for India on march 30th, while on H4, they got their h4 stamped april 5th, and still dont know about status of h1b application. The i94 number mentioned in the I129 is the old I94 which was surrendered at port of exit. When they reenter sometime in may, she will get new I94 , which will of course, be valid exactly as the I94 mentioned on I129.
1. Will there be any other problem in port of entry , as she will be entering on H4 stamping.
2. Will the h1b application get rejected or queried.

My VISA stamped expired long back. I have valid H1 extension and my I94 is valid till October 30 2007. I am in the process of 8 th year H1 extension. Do I need to revalidate my visa to apply I � 485?
I hope lots of us may sail in the same boat. Any answer guys?

I didn't have any problem at Port of Entry. The immigration officer scanned the visa, but I guess he didn't find anything linking to the fact that the previous company has canceled the H1.

If I apply for H1b in April, 2008 and choose consular visa processing, and the H1b starts in Oct, 2008. Do I have to go to the consular for a H1b visa? I might receive a EAD from 485 before October, and if I do, I would like to use EAD but keep the option of H1b open.
Can anyone answer me???
Say I don't activate my H1b in Oct 2008, but H1b is valid for three years, does it mean I can activate it any time by going to the consular for a H1b visa from 10/2008 to 09/2011? Of course I will keep my status valid (AOS) throughout the period.

Since you were working all these times, please carry the W2 for 2008 ( for both of you). They may/may not ask for this, but its safe to carry the document
I am currently on H1 but planning to go on H4 due to current economic scenario.
I am planning to go to India due to some family reason and planning to get COS from H1 to H4 in India.
I have my salary slips and my husband has also maintained his status throughout.
Has anyone heard any horror stories about H4 stamping cases getting denied.
What documents they ask for when you go for COS from H1 to H4. Besides salary slips can they ask for my W-2's or they need my husband's W-2's only

My wife's I-539 got approved this month (H4 -> F1). My lawyer said that applying for AOS is not an issue as long as she does not travel outside the country while her AP is pending.

Hello,
I have an "intend to deny" on my GC as EB1 that I got by applying myself as primary and wife as secondary. wife is on h1b and me on h4.we got EADs and if the GC is denied, we will lose the EAD.
I want to incorporate for several reasons hence i will be using the EAD for that.
using EAD invalidates H4 ? but H4 is automatic status based on H1b .
My wife did not apply for GC as primary and me on secondary but we intend to that in 3 years when it becomes current as EB3.

It should not be a problem. Our GC's were approved when we were overseas and we came in using AP's.
Try to bring print outs of approval from USCIS website. If you have that, they will admit you as a PR. I tried explaining but they didn't listen and used the AP. If you have a printout they willl stamp your passport as a PR and let you in.

:confused: I got very anxious when my co lawyer told me that I got a query from INS.
I recently transfered my H1 to current employer and started working for him. Even I got receipt number. When I last tracked the number in INS web site it says mail has been sent out asking for more information.
Company lawyer told me to produce all my paystubs ever since I started to work in US.
I am wondering will this cause any issue. Is this a normal procedure ?
Please help me, if any has any kind of information. Please share with me. My Id madhyastha@yahoo.com
